Why WorkCover Queensland Can Stop Your Weekly Compensation Payments
Weekly compensation payments provide a vital financial lifeline while you recover from a workplace injury. However, these payments are not indefinite. Under the Workers’ Compensation and Rehabilitation Act 2003, there are several specific triggers that allow WorkCover Queensland to legally cease your benefits.
1. Recovery and Return to Work
The most common reason for payments to stop is that you have recovered.
- Medical Fitness: If your doctor issues a Work Capacity Certificate stating you have “no incapacity for work,” payments will end.
- Return to Full Duties: Once you return to your pre-injury role and hours, you are no longer suffering a loss of wages.
2. Reaching the Maximum Limit
Queensland law sets strict “caps” on how much and how long you can be paid.
- Five-Year Limit: Weekly payments generally cannot exceed a total of five years.
- Financial Cap: Payments stop once you have reached the maximum total compensation amount (currently over $200,000, though this figure is indexed annually).
3. Assessment of Permanent Impairment
If your injury has stabilised (meaning it is unlikely to improve further), WorkCover will ask a doctor to perform a Permanent Impairment Assessment. Once a Notice of Assessment is issued and you are offered a lump sum, your weekly wage replacements cease stop 20 business days later —regardless of whether you accept the offer.
4. Non-Compliance and Conduct
WorkCover can suspend or stop payments if you fail to meet your obligations, such as:
- Refusing Reasonable Treatment: Failing to attend rehabilitation or medical appointments.
- Failure to Provide Certificates: If you don’t provide an up-to-date Work Capacity Certificate, covering every day off, the insurer cannot verify your inability to work.
- Unreasonable Rejection of Light Duties: If your employer offers “suitable duties” that fit your medical restrictions and you refuse them without a valid reason.
Understanding these triggers helps you stay compliant and ensures your transition from compensation back to the workforce is as smooth as possible.
